Learn Child Custody Laws To Win The Case

You have to know and understand the child custody laws if you want to win the case of your child custody.

First of all what is custody? Custody is the right to take part in your child’s life. Staying together you and your partner share the custody of your child, but being separated or divorced you divide the custody.

In the case when one parent gets the sole custody, the other parents often gets the visitation rights. To say in other words the non custodial parent has rights to see the child on certain days. Visitations can be different, you can make a schedule of visitations which is very comfortable for all of you. When the child attains his/her majority the court loses jurisdiction for the custody orders.

You should make a decision of how to share your child when you get divorced. If you and your ex partner come to an agreement about the new arrangement then you will start living it. But i? you can not come to an agreement the court will make the arrangement for you.

There are two common categories of the child custody: legal and physical. The child lives with the parent who has physical custody. Legals custody means that you make main decisions about your child’s upbringing.

In turn legal and physical custody has two categories too, they are sole and joint custody. The sole custody gives the exclusive rights for the child to a custodial parent, and joint custody allows both parents to share th rights.

Legal custody gives the rights to the parent/ parents to make the main resolutions about the child. The custodial parent is the child’s tutor and he/she makes all the important resolutions about the child’s upbringing such as education, health, religion and well-being.

Sole legal custody gives the exclusive rights for the custodial parent to make all important resolutions in the child’s life. The negative side of the sole custody is that the non custodial parent is torn from the child’s life which is not good for the child too. The non custodial parent get rights for visiting the child only. Sole custody is reasonable when one of the parents have problems with alcohol, drugs, mental health or if the child has ever been hurt by the parent.

Both parents make the important resolutions about their child if they get joint custody. The parents also should decide together what school the child attends, where the child spends holiday, what medical treatment the child gets etc. Joint legal custody is good for the child, because the child sees and spends time with both parents and the child doesn’t feel that he/she is torn from one of the parents.
